Privacy Policy

1. Who we are

This Privacy Policy explains how EMPORIO MODELS SARL (trading as Emporio Models and Emporio Models Marrakech), a limited liability company registered in Marrakech, Morocco, ICE 002373328000090, with its office at Hay Targa 693, Marrakech, Morocco (“Emporio Models”, “we”, “us”) collects and uses personal data through emporiomodels.com, emporiomodels.com/marrakech, our booking and model management application (app.emporiomodels.com) and our WhatsApp, email and social media channels.

We are the data controller. The person responsible for data protection is Zakaria Elkhoudimi, Director. Contact: zach@emporiomodels.com.

We process personal data in accordance with Moroccan Law No. 09-08 of 18 February 2009 on the protection of individuals with regard to the processing of personal data and its implementing decree, under the supervision of the Commission Nationale de contrôle de la protection des Données à caractère Personnel (CNDP). Where the EU General Data Protection Regulation (GDPR) or another law applies to you, we also respect the rights it gives you.

2. Data we collect

Model applications (Be a Model form): name, date of birth or age, nationality, city and country of residence, contact details (email, phone, WhatsApp, Instagram), height and measurements, hair and eye colour, experience, and, for applicants under 18, the details and consent of a parent or legal guardian.

Photos and videos: digitals, portfolio images, polaroids and videos you send us or that are produced during castings and bookings.

Contact Us forms and client inquiries: name, company, email, phone, project details, dates, locations and any information you include in your message.

WhatsApp messages: when you contact us on WhatsApp, including through Meta’s WhatsApp Business Platform (WhatsApp Business API), we receive your phone number, WhatsApp profile name, the content of your messages and any files you send, together with delivery and read status. WhatsApp is operated by Meta Platforms; its processing is governed by WhatsApp’s own terms and privacy policy.

Represented models and partners: identity and passport or ID details, address, bank details, contracts, invoices, booking history and availability, needed to manage representation and payments.

Technical data: IP address, browser and device type, pages visited and referring site, collected through server logs, cookies and Google Analytics (see “Cookies and analytics”).

3. Why we use your data

To assess model applications and contact applicants; to represent models and promote them to clients and partner agencies; to answer inquiries and prepare quotes; to organise castings, bookings, travel and payments; to draft, sign and keep contracts and invoices; to send booking-related messages by email or WhatsApp; to secure and improve our website and application; and to meet our legal, accounting and tax obligations.

The legal bases are: your consent (for example when you submit an application or message us, and for analytics cookies); the performance of a contract or steps taken at your request before entering into one; our legitimate interest in running and promoting a model agency; and compliance with legal obligations. You can withdraw your consent at any time without affecting earlier processing.

We do not sell personal data and we do not use it for automated decision-making.

4. Who we share it with

Clients and partner agencies: we share model profiles (name, photos, measurements, experience and availability) with clients and partner or mother agencies only for the purpose of castings, bookings and representation. Contact details and identity documents are shared only when needed to perform a confirmed booking or contract.

Service providers acting on our instructions: web hosting, email (Google Workspace / Gmail), Meta’s WhatsApp Business Platform, content delivery, electronic signature and storage tools, accountants and lawyers. They may only use the data to provide their services to us.

Authorities when required by law or to protect our rights.

Some of these recipients are located outside Morocco, including in the European Union, the United Arab Emirates and the United States. Where data is transferred abroad, we do so in accordance with Law 09-08 and the requirements of the CNDP, or with your consent, and with appropriate safeguards.

5. How long we keep it

Model applications not taken forward: up to 24 months after the last contact, so that we can consider you for future castings, unless you ask us to delete them earlier.

Represented models: for the duration of representation and up to 5 years after it ends; images used in published work may remain in our portfolio archive in line with the applicable contract.

Client inquiries and Contact Us messages: up to 3 years after the last exchange.

WhatsApp conversations: up to 3 years after the last message, or longer where they relate to a booking or contract.

Contracts, invoices and accounting records: 10 years, as required by Moroccan commercial and tax law.

Analytics data: up to 14 months.

6. Your rights

Under Law 09-08 you have the right to be informed, the right of access to your data, the right of rectification and updating, the right of opposition (to object, on legitimate grounds, to processing, and to object at any time to direct marketing) and the right to request the deletion of data that is inaccurate, incomplete or no longer needed. Where the GDPR applies you also have the rights to restriction and portability.

To exercise these rights, email zach@emporiomodels.com with the subject “Personal data request” and enough information to identify you. We may ask for proof of identity. We will reply within 30 days at the latest.

If you are not satisfied with our answer, you may lodge a complaint with the CNDP (www.cndp.ma), Rabat, Morocco, or with the data protection authority of your country.

7. Cookies and analytics

Our website uses a small number of cookies and similar technologies. Essential cookies make the site and forms work. We also use Google Analytics 4 (Google LLC / Google Ireland Ltd) to measure traffic and understand how visitors use the site; it sets cookies such as _ga and collects pseudonymous data (pages viewed, approximate location, device, referrer). Google may process this data outside Morocco.

You can block or delete cookies in your browser settings and opt out of Google Analytics with the browser add-on at tools.google.com/dlpage/gaoptout. Blocking analytics cookies does not affect the use of the site.

8. Minors

We may represent models under 18 only with the written consent and involvement of a parent or legal guardian. Applicants under 18 must submit the Be a Model form with their parent or guardian, and we communicate with the parent or guardian for all bookings.

9. Security

We use appropriate technical and organisational measures to protect personal data, including encrypted connections (HTTPS), access restricted to authorised staff, password-protected systems and private storage for identity documents and contracts. No transmission over the internet is completely secure, so please avoid sending sensitive documents by unsecured channels unless we ask for them.

10. Changes and contact

We may update this Privacy Policy. The current version is always published on this page with its effective date. Material changes will be announced on the website.
